THE CITY OF GRAND RAPIDS ELECTRONIC BILLING PRESENTMENT TERMS OF SERVICE AGREEMENT


PLEASE READ THE FOLLOWING TERMS OF SERVICE AGREEMENT:


ACCEPTANCE OF TERMS AND CONDITIONS

By enrolling in any of the City of Grand Rapids Electronic Billing Presentment services ("Presentment Service"), you agree to the terms and conditions outlined in this Service Agreement ("Agreement").

ELECTRONIC BILLING PRESENTMENT

The Presentment Service is hosted by InfoSend, a third-party provider specializing in electronic bill presentment. This service allows you to view your statements online. To access your current statement and up to 12 months of billing history, use the provided link and log in with the username and password you created during enrollment.

For information on bill payment options, visit grandrapidsmi.gov/water.

If you are unable to access your account or view your bill online, please contact City of Grand Rapids Customer Service at 616-456-3000 for assistance.

ENROLLMENT

Enrollment in the Presentment Service requires you to represent and warrant that either: (i) you are using your true identity and all information provided to the City of Grand Rapids is accurate, current, and complete; or (ii) you are authorized to access the account information associated with the User Profile.

If you are presented with account information that you are not authorized to access, you must immediately stop using the service and notify the City of Grand Rapids.

The City of Grand Rapids does not charge a fee to enroll in or use the Presentment Service.

TERMINATION OF PRESENTMENT SERVICE

You may cancel your enrollment in the Presentment Service at any time without charge. To discontinue the service, submit a cancellation request using the contact information provided under "Notices to the City of Grand Rapids." Cancellation will become effective within ten (10) days after the request is received.

The City of Grand Rapids reserves the right to suspend, modify, or terminate the Presentment Service at any time and for any reason, at its sole discretion.

PRIVACY OF INFORMATION

The City of Grand Rapids is committed to protecting your privacy. By using the Presentment Service, you acknowledge that the City and its service provider may receive certain personal and confidential information necessary to provide and maintain the service. The City will not sell, rent, or disclose personally identifiable information to third parties except as necessary to operate the Presentment Service, comply with applicable laws and regulations, respond to lawful government or court orders, or with your consent.

You agree to provide accurate and truthful information when enrolling in or using the Presentment Service. You further agree not to alter, falsify, forge, or otherwise tamper with any communications or information received through the service.

The Presentment Service utilizes security measures designed to protect your information from unauthorized access, loss, misuse, or alteration. The service employs industry-standard security protocols, including Secure Sockets Layer (SSL) technology, to help safeguard data transmission.

CITY OF GRAND RAPIDS’ RESERVED RIGHTS

The City of Grand Rapids reserves the right to invoke all legal defenses to any actions for damages, including, but not limited to, the defense of the doctrine of governmental immunity. The City is not responsible for failures, interruptions, or delays caused by communication networks or other systems outside of its control. The City does not guarantee the accuracy, completeness, availability, or timeliness of information provided through the Presentment Service and shall not be liable for any loss, damage, or decisions resulting from reliance on such information. The City will make reasonable efforts to ensure the reliable operation of the Presentment Service and to assist in resolving any service-related issues.

To help protect against email and internet fraud, including phishing attempts, please be aware of the following:

DISCLAIMER OF WARRANTIES

The City of Grand Rapids provides the Presentment Service “as is” and does not make any warranties express or implied, including, but not limited to, any warranties of merchantability, fitness for a particular purpose, or non-infringement of third-party proprietary rights. The City makes no warranties other than those stated in this Agreement.

The City is not liable for any damages arising from the use of the Presentment Service, including direct, indirect, incidental, consequential, and punitive damages.

By using the Presentment Service, you acknowledge and agree that use of the service is at your own risk.

AMENDMENT

The City of Grand Rapids may update or modify this Agreement at any time. Any changes will become effective upon posting or as otherwise communicated by the City, in accordance with applicable law. Notice of changes may be provided through the Presentment Service website or other communication channels. Your continued use of the Presentment Service after notice of any changes constitutes your acceptance of the updated Agreement.

ASSIGNMENT

You may not assign this Agreement to any other party.

GOVERNING LAW/VENUE/TORT CLAIMS ACT

This Agreement shall be governed by the law of the State of Michigan without regard to its conflicts of laws provisions, and any action or lawsuit related to this Agreement will be adjudicated in a court of competent jurisdiction in the County of Kent. Prior to filing any action or lawsuit related in any way to this Agreement, you must comply with the provisions of the Tort Claims Act (Government Code Section 900 et seq.).

USE OF ELECTRONIC COMMUNICATION

By accepting below or by using the Presentment Service, you agree that all disclosures and communications between you and the City of Grand Rapids relating to the Presentment Service, including this Agreement, may be provided electronically, including through postings on the City’s website, in accordance with applicable law.

You further agree that any electronic disclosures or communications issued by the City are deemed delivered when transmitted by the City.
